Rental Terms & Conditions
By booking, submitting payment, or participating in any activity involving The Play Lounge, LLC ("Company") equipment, the Renter acknowledges that they have read, understand, and agree to all terms of this Rental Agreement.
Liability & Risk
Waiver & Release of Liability
The Renter releases and forever discharges The Play Lounge, LLC, its owners, employees, contractors, and agents from any and all claims, liabilities, or damages arising from injury, illness, death, or property damage related to the use or presence of Company equipment.
Assumption of Risk
The Renter understands that participation in soft play activities involves inherent risks, including falls, collisions, illness, or injury, and voluntarily assumes all risks for themselves and all participants, including minors.
Indemnification
The Renter agrees to indemnify and hold harmless The Play Lounge, LLC from any claims, damages, losses, or legal expenses arising from the use of Company equipment, even if caused by Company negligence. If the Renter initiates legal action and does not prevail, the Renter agrees to pay all legal fees and court costs.
No Warranties
All equipment is provided AS IS, without warranties of any kind, express or implied.
Limitation of Liability
To the fullest extent permitted by Kentucky law, Company liability shall not exceed the total rental fee paid.
Rules & Safety
- Children ages 8 and under only
- Adult supervision (18+) required at all times
- Socks required — NO shoes or bare feet
- NO pets
- NO food, drinks, gum, or candy
- NO sharp objects, jewelry, or eyeglasses
- NO face paint, slime, markers, glitter, confetti, or messy materials
- NO rough play
- NO moving or dismantling equipment
- NO smoking, BBQs, or heat sources within 50 feet
- Do not exceed maximum capacity
Renter Responsibilities
- Renter is responsible for informing all guests of these rules
- Equipment may not be loaned or sublet
- Renter assumes responsibility for lost, stolen, damaged, wet, or excessively dirty equipment
- Security deposits (if applicable) are refunded within 5 business days, pending inspection
- Renter must provide a flat, clean setup area free of debris, dirt, gravel, and pet waste
- If not present during delivery or pickup, Renter must coordinate venue access
- All ball pit balls must be returned before pickup
- Failure to return ball pit balls will result in a $250 Ball Pit Reset Fee
- Renter grants The Play Lounge, LLC permission to use event photos or videos for marketing
Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Kentucky, with venue in Fayette County, Kentucky.
